Plaintiff Sha-Heed Rahman, a Shīʿī Muslim prisoner in the New York Department of Corrections (“DOCS”), brought this lawsuit against the respondents, various DOCS prison officials, alleging that the respondents violated a settlement agreement, retaliated against him, and conspired to punish him for pursuing his First Amendment rights to exercise his religion and access the courts. The plaintiff originally brought a civil rights lawsuit in 2004, claiming that the respondents violated his First Amendment rights by only employing Sunnī chaplains at DOCS facilities and not allowing inmates to observe Shīʿī holy days. The plaintiff and the respondents entered into a settlement agreement which included the plaintiff’s right to an alternative Shīʿī Friday prayer (jumuʿa) service. In this current suit, the plaintiff claimed that the respondents had failed to provide a separate Shīʿī service and failed to provide Shīʿī study classes. The plaintiff also claimed that when he filed grievances in an attempt to enforce the settlement agreement terms, he was sent to the Special Housing Unit as punishment. The respondents filed a motion to dismiss the claim. The District Court granted the respondents’ motion to dismiss, determining that the plaintiff failed to state a claim. However, the District Court granted the plaintiff leave to amend the claim regarding his First Amendment and retaliation concerns with respect to the provision of Shīʿī study classes.

Faris Matiyn, an inmate at the Attica prison, mounted a § 1983 claim against the commissioner of the New York State Department of Corrections and prison superintendent Walter Kelly. The plaintiff alleged that the prison violated his First Amendment free exercise right by not allowing Sunnī and Shīʿī Muslims—the two major Muslim denominations—to have separate worship services. The Court granted summary judgment in favor of the defendant, concluding that the plaintiff did not speak for the majority of the Sunnī Muslim community and that keeping the two groups together satisfied legitimate penological objectives, such as maintaining a safe prison environment. 

Ibn Ḥārith al-Khushanī recorded the following case as a ḥikāya, an anonymous report: A Christian appeared before the judge Aslam b. ʿAbd al-ʿAzīz, petitioning to be executed. But he was rebuked because he had committed no crime. The text explains that the Christian’s behaviour was motivated by his desire to die in imitation of Jesus, as an act of virtue (faḍīla), although—as our source points out—Jesus himself did not seek martyrdom. In response to the judge’s admonishment, the Christian explained that he would not in truth die. While his shibh, or likeness (i.e., a body that resembled his body), might perish, his real self would ascend to the heavens upon execution. The judge aimed to disprove this theory by ordering the Christian flogged. Thus, the judge illustrated that the Christian could indeed suffer pain and likewise would suffer death if a sword were to cut his neck.

Translation

Ibn Ḥārith said: I heard someone recounting that a Christian went [to the judge] asking to be put to death. Aslam reprimanded him asking him: “Woe unto you! Who provoked you to ask for your own death if you have committed no crime?” The stupidity and ignorance of the Christian led him to take upon himself a virtuous act (faḍīla) when nothing of the kind was attributed to Jesus, son of Mary – God bless Muḥammad and Jesus. The Christian told the judge: “You assume that if you execute me I would be the one killed.” The judge asked him: “Who else could be the one killed?” The Christian answered: “A likeness of me (shibhī) that was cast on a body is what you will execute, while my real self in that same hour will directly go to heaven.” Aslam then told him: “We lack sufficient information to have an opinion on the [outcome] that you argue for,[1]but you lack what it takes to make you realize that you are deceiving yourself. There is however a way to reveal what is right to us and to you.” The Christian asked the judge: “What could that be?” The judge Aslam summoned his court assistants (aʿwān) and told them: “Take the whip,” then ordered them to strip the Christian which they did, and then ordered them to beat him. When the Christian felt the flogging he became agitated and screamed. Aslam asked him: “On which back is the flogging taking place?” “On mine!” said the Christian. Aslam told him: “In the same way the sword will cut your neck, don’t be deluded into believing otherwise.”

Ibn Ḥārith al-Khushanī recorded the following case as a ḥikāya, an anonymous report: A Christian appeared before the judge Aslam b. ʿAbd al-ʿAzīz, petitioning to be executed. The anecdote offers insight into the historical role of judges during a period of religious dissent in the Umayyad Caliphate, while the author's narrative voice demonstrates past judicial approaches to rationality, humor, and violent penalization.

This is a reference to the Shīʿī identification of reciting the opening formula in prayer aloud (al-jahr biʾl-basmala) as one of the five indicators of faith (i.e., what distinguishes a Shīʿī from a non-Shīʿī). This is a reference to some individuals and groups who pretended to have affection for and claimed affiliation with the House of the Prophet. Hossein Modarressi uses this reference to argue that some "esoterics" attempted to attempted to acquire social distinction by setting themselves up as devoted supporters of the Shīʿī cause and would often forge materials and ideas and ascribe them to the Imams.

In this Twelver Shīʿī collection of ḥadīth, Kulaynī (d. 329/940–1)records a report about ʿAlī’s gift of some five awsāqof dates (approximately 15 kilograms) to a poor man whose custom was not to ask for handouts. In her chapter on land and leadership in early Islamic societies in Justice and Leadership in Early Islamic Courts, Intisar Rabb cites this ḥadīthas an example of how the ʿAlids gained economic independence through their ownership of the valuable land of Bughaybigha. It also indicates that the ʿAlids used the profits from the land for charitable purposes.

Text and Interpretation: Imam Jaʿfar al-Ṣādiq and His Legacy in Islamic Law examines the main characteristics of the legal thought of Imam Jaʿfar al-Ṣādiq, a preeminent religious scholar jurist of Medina in the first half of the second century of the Muslim calendar (mid-eighth century CE). Numerous works in different languages have appeared over the past half century to introduce this school of Islamic law and its history, legal theory, and substance in contexts of Shīʿī law.

While previous literature has focused on the current status of the school in its developed and expanded form, this book presents an intellectual history of how the school began. The Jaʿfarī school emerged within the general legal discourse of the late Umayyad and early Abbasid periods, but was known to differ in certain approaches from the other main legal schools of this time. Namely, the Jaʿfarī school expanded the tools for legal interpretation generally and contracts specifically, to a degree unmatched by any of its counterparts in the Muslim legal tradition. In addition to sketching the origins of the school, the book examines Jaʿfar al-Ṣādiq’s interpretive approach through detailing his position on a number of specific questions, as well as the legal canons, presumptions, and other interpretive tools he adopted.
