Hussain v. Principi (D.D.C. 2004): Employment Discrimination Case

An Indian Muslim physician, who formerly worked at a Veteran Affairs Medical Center, sued the Secretary of Veteran Affairs under Title VII, alleging discrimination based on race, religion, and national origin; the failure to promote; retaliation; a hostile work environment; and constructive discharge.  The defendant argued that the plaintiff did not receive a promotion due to unsatisfactory work performance. Concluding that the plaintiff did not prove he suffered an adverse employment action and therefore failed to make out a prima facie case of discrimination, the Court granted the defendant’s motion for summary judgment.
