Indonesian Presidential Decree No. 150 of 1959 on Returning to the 1945 Constitution

This presidential decree, issued by then-President Soekarno, dissolves the Constituent Assembly established to draft a new permanent constitution for Indonesia. The decree acknowledges that the Piagam Jakarta (Jakarta Charter - the obligation on all Muslims to carry out shari'a) gives life (menjiwai) to the Constitution, and constitutes an integrated framework (rangkaian-kesatuan) with the Constitution. It ensures, however, that shari'a has no substantive legal effect in Indonesia. This statement, which was designed to appease the Islamic parties that proposed Islam become the foundation of Indonesia, was included in the 'Considerations' of the decree in order to signify a distinct separation between the Constitution and the Charter.
