The appellant sought to challenge the decision of the Kutacane Shari'a Court to grant the respondent an irrevocable divorce (talak satu ba'in sughra). The Court found that legislation requires a proceeding to be conducted in camera if it is dealing with both a marriage ratification and an irrevocable divorce, which, in this case, it was. As it was conducted in an open forum, however, the Court held the decision of the lower court must be overturned.
