Abouzahr v. Matera-Abouzahr, 824 A. 2d 268 (N.J. Super. Ct. App. Div. 2003): Unsubstantiated fear of child abduction to Lebanon rejected in child custody case

In this case, the New Jersey Superior Court, affirming the decision of the lower court, noted that the mother's allegations of the probability of her ex-husband's taking and abducting their child, whose custody belonged to the mother, to Lebanon was baseless. While the mother's fears were recognized as being "genuine," the Court nevertheless ruled that fear alone, which remained unsubstantiated, was not sufficient to deprive the non-custodial parent of his right to visitation.
