Pirayesh v. Pirayesh, 596 S.E.2d 505 (S.C. Ct. App. 2004): Iran’s non-signatory status to The Hague Convention on child abduction is a relevant factor in custody disputes

In this case, the Court of Appeals of South Carolina, while remanding the case for further proceedings on the matter of child custody, affirmed the relevant part of the lower court's decision restricting the father's right to visit his home country, Iran. The Court relied on the fact that the husband had threatened the wife of abducting their child, and also the fact that the third country in question was not a signatory to The Hague Convention, making it difficult to remedy the situation in the event abduction occurred.
