The prosecution submitted that, on 16 April 2011 at around 10.00pm, the accused was found providing gambling facilities to the public. Specifically, the accused had been faciliting bingo-style (toto gelap) bets via a mobile phone, and taking around 20 per cent of all takings. The prosecution submitted that this type of activity was in contravention of arts 5 and 23(1) of Aceh Qanun No. 13 of 2003 on Gambling.
Based on items seized at the time of the arrest of the accused, which included IDR 1,185,000 in cash, as well as corroborating information provided by two police witnesses, the court found the accused guilty of the charges submitted by the prosecution. Citing Surah Al-Maidah verse 90, the court condemned the actions of the accused and sentenced him to seven strokes of the cane.
