The prosecution submitted that, on 14 March 2012 at around 4.30pm, the accused was found providing gambling facilities to the public. Specifically, the accused had been facilitating bingo-style (toto gelap) bets via a mobile phone to a larger gambling agent between 1.00pm and 5.00pm every Monday, Wednesday, Thursday, Saturday and Sunday, while taking commission of up to IDR 50,000 per transaction. The prosecution submitted that this activity was in contravention of arts 5 and 23(1) of Aceh Qanun No. 13 of 2003 on Gambling. On the grounds, however, that neither the prosecution nor accused attended court, the court dismissed the case and ordered that the state pay costs.
