The plaintiff submitted that he had entered into a musyarakah agreement with the defendants on 3 June 2013, pursuant to which the defendant had received IDR 30 million. The defendants were obliged to pay IDR 1,283,333 in monthly repayment instalments, which comprised IDR 833,333 (principle sum), IDR 420,000 (profit share), and IDR 30,000 (risk reserve). The plaintiff submitted that he had been patient in waiting for the defendants to fulfil their repayment obligations, however, that the defendants had defaulted on the agreement, causing the plaintiff material and immaterial damages totalling IDR 40,219,138.
The plaintiff then, however, withdrew his application.
