Berau Regency Regulation No. 2 of 2009 on the Prohibition on the Distribution and Sale of Alcoholic Beverages

This regional regulation replaces Berau Regency Regulation No. 4 of 2008 on the Prohibition on the Circulation and Sale of Alcoholic Beverages. It continues the prohibition on all persons and legal entities from distributing and/or selling alcoholic beverages (art 3(1)), but makes an exception for alcoholic beverages consumed for health benefits (art 3(2)), five-star hotels and other places stipulated in regental regulation or decree (art 4), and foreign tourists (art 5). Intoxication in a public place is similarly prohibited (art 6). Contravention of arts 3(1) and 4 carries a maximum penalty of six months' imprisonment or a fine of IDR 50 million (art 11(1)), while contravention of art 6 carries a maximum penalty of six months' imprisonment or a fine of IDR 5 million (art 11(2)).
