Kendari Religious Court Decision No. 367 of 2015: Irrevocable Divorce Application Dismissed Due to Incorrect Jurisdiction

The parties were married on 31 August 2004 and had one child. For the first two years of their marriage the parties had lived together in a rental property on a university campus, after which they separated indefinitely. The plaintiff submitted that, since 2007, the marriage had been disharmonious as a result of regular quarrelling, resulting from the defendant:

  1. often physically assaulting the plaintiff; and
  2. not providing the plaintiff with emotional and financial support since 2011.

After inspecting the plaintiff's claim, however, the court determined that the plaintiff's place of residence was outside the bounds of its jurisdiction and, therefore, dismissed the claim.
